Welcome to Van Hugo! Van Hugo is a brand operated by Gennici Global ("we," "us," "our"). We operate this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated coffee shopping experience (the "Services"). Van Hugo is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced here (these "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use or access our Services.

Section 1 - Access and Account

By agreeing to these Terms, you confirm that you are at least 18 years old, or that you have the consent of a parent or guardian to use the Services. You also confirm that you consent to allow any minor dependents to use the Services on devices you own or manage.

To use the Services - including browsing our store or purchasing products - you may be asked to provide information such as your email address, billing, payment, and shipping details. You confirm that the information you provide is accurate, current, and complete, and that you have the right to provide it.

You're responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, or license your account to anyone else.

We make every effort to accurately represent our products, but coffee packaging, roast appearance, and colors may look slightly different on your screen than in person, depending on your device.

Product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product, or to limit quantities available to any person or region, at our discretion.

Section 3 - Orders

Placing an order is an offer to purchase, which we may accept or decline at our discretion. Your order isn't confirmed until we accept it and process your payment. Please review your order carefully before submitting - we may not be able to accommodate cancellation requests once an order is accepted. If we're unable to accept, change, or need to cancel your order, we'll notify you using the email, billing, or phone details provided at checkout.

Returns and exchanges are handled solely in accordance with our Return & Refund Policy.

You confirm that your purchases are for personal or household use, not for commercial resale or export.

Section 4 - Prices and Billing

Prices, discounts, and promotions may change without notice. The price charged is the price in effect at the time your order is placed, as shown in your order confirmation email. Unless stated otherwise, posted prices do not include applicable taxes, shipping, or handling charges.

Prices in our online store may differ from prices at pop-ups, markets, or other sales channels. Promotional offers are governed by their own terms; where those conflict with these Terms, the promotion terms apply.

Delivery times shown at checkout are estimates only and are not guaranteed. We are not responsible for delays caused by courier partners, customs, weather, or other events outside our control. Once we hand off your order to our courier partner, risk of loss passes to you - though we're always happy to help you resolve an issue with a damaged or lost shipment (see our Return & Refund Policy).

All content on our Services - including trademarks, text, images, graphics, product photography, and design - is owned by Van Hugo/Gennici Global, our affiliates, or licensors, and is protected under Indian copyright, trademark, and other intellectual property laws.

You may use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, publicly display, or create derivative works from any material on the Services without our prior written consent. All rights not expressly granted are reserved.

"Van Hugo" and our logos, product names, and designs are trademarks of Gennici Global. You may not use them without our prior written permission. Shopify's name and logo are trademarks of Shopify Inc.

Section 7 - Optional Tools

We may give you access to third-party tools as part of the Services, which we don't control or monitor. These are provided "as is," without any warranty, and we're not liable for your use of them. Any use of such tools is at your own risk - please review the relevant third party's terms before use.

Our Services may link to third-party websites. We don't examine or take responsibility for the content, accuracy, or practices of those sites, and any transactions or interactions you have with them are at your own risk.

Section 9 - Relationship with Shopify

Van Hugo is powered by Shopify, which enables us to provide the Services to you. Any sales you make through our store are made directly with Gennici Global (operating as Van Hugo) - not with Shopify. Shopify is not responsible for any aspect of these sales, including any injury, damage, or loss resulting from purchased products.

All personal information we collect is handled in accordance with our Privacy Policy. Because our Services are hosted by Shopify, Shopify also collects and processes some information about your use of our store to help provide and improve the Services. To the fullest extent permitted by applicable Indian law, Gennici Global, our partners, officers, employees, affiliates, and service providers (including Shopify and its affiliates) will not be liable for any indirect, incidental, punitive, special, or consequential damages - including lost profits, lost revenue, or loss of data - arising from your use of the Services or any products purchased through them, even if we've been advised of the possibility of such damages.

You agree to indemnify and hold harmless Gennici Global, Shopify, and our respective affiliates, officers, and employees from any claims, damages, or liabilities (including reasonable legal fees) arising from your breach of these Terms, your violation of any law or third-party right, or your use of the Services.

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full effect.

Our failure to enforce any right or provision of these Terms doesn't waive that right. These Terms, together with any policies referenced here, form the entire agreement between you and us regarding the Services, superseding any prior agreements or communications.

Section 22 - Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Services will be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal.
